1 Year Limited Warranty for Reverie® R220™ Adjustable Foundation

Ascion, L.L.C. d/b/a Reverie ( “Reverie”) warrants to the individual person, end-user ( “Purchaser”) that during the one (1) year term of this Limited Warranty, Reverie will, at its sole discretion and option, repair or replace Purchaser’s adjustable bed foundation (“Foundation”) if it is found to be defective due to manufacturer defect, subject to the limitations set forth herein.

This Limited Warranty begins on the “Warranty Commencement Date” which is the date of Purchaser’s original purchase for a new, unused Foundation from Reverie or an authorized retailer. Retailer floor models are NOT considered a new, unused Foundation. This Limited Warranty extends only to the original Purchaser and may not be transferred. If the Purchaser is not the original Purchaser of this Foundation, any later person takes the Foundation “AS IS,” “with all faults'' and without warranty. PROOF OF PURCHASE WILL BE REQUIRED TO DEMONSTRATE THAT PURCHASER IS THE ORIGINAL PURCHASER AND THE FOUNDATION WAS PURCHASED FROM AN AUTHORIZED RETAILER, AND ELIGIBLE TO MAKE A VALID CLAIM UNDER THIS LIMITED WARRANTY.

1 YEAR LIMITED WARRANTY

Upon receiving reasonable written notice during the first one (1) year from the Warranty Commencement Date (“Warranty Period”), Reverie will either offer replacement parts for the foundation parts that are found to be defective or will replace Purchaser’s defective foundation in the event the foundation cannot be repaired. At all times during the Warranty Period, Purchaser shall bear all service, transportation, inspection, labor and shipping costs related to the delivery and/or replacement of any defective Foundation or Foundation part(s).

Purchaser must provide evidence of a manufacturing defect that is sufficient for Reverie to determine, in its sole discretion, that the Foundation has a manufacturing defect, as well as provide proof that Purchaser is the original Purchaser, and Purchaser must return the defective Foundation or any and all defective parts to Reverie. The Limited Warranty applies only when the Foundation has been properly used by the original Purchaser. Proper use means using the Foundation on a level surface with an equal distribution of weight that does not place the Foundation on casters or risers. Proper use also means that the Foundation was not misused by the consumer, as defined by the manufacturer, including but not limited to not exceeding its weight capacity. Foundations are not rated to support weights in excess of 650 pounds inclusive of the mattress and bedding. The Foundation is not intended to be used without a mattress and will structurally support the referenced weight, provided it is evenly distributed across the top surface of the Foundation. Exceeding this weight restriction or loading weight on the Foundation unevenly could damage the Foundation and/or cause injury and will void the Limited Warranty. The Limited Warranty is voided if any modification is made to the Foundation or any part of the Foundation as delivered is removed.

ADDITIONAL TERMS AND CONDITIONS

This Limited Warranty does not apply: (a) to any damage caused by the Purchaser; (b) if there has been any unauthorized repair or replacement of Foundation parts; (c) if the foundation is used with an improper bed frame (d) if the Foundation has been mishandled (whether in transit or by other means), subjected to physical abuse or misuse, or otherwise used in any way inconsistent with the operation and maintenance procedures outlined in the Owner’s Manual, this Limited Warranty, and any other applicable document published or approved by Reverie; (e) to damage to mattresses, fabric, or items supplied by any authorized reseller of the Foundation, (contact the reseller or other relevant party for warranty information on these items); or (f) if there have been any unnecessary service calls, including costs for in-home service calls solely for the purpose of educating the consumer about the Foundation (g) if the Foundation has been mishandled, causing the hardware to loosen over time; please note that all hardware becomes loose over time during normal use and the loosening of hardware is not considered in itself a manufacturing defect (f) if there are less than 5 broken wire mesh welds present at the time of purchase (please note that it is not unusual for wire mesh welds to loosen or break over time during normal use); (g) to bedding used in commercial settings including but not limited to hotels, motels, or institutional facilities; (h) to bedding sold “as is”, or floor samples, or bedding purchased from second hand parties, non-retail establishments or received as a promotional item; (i) to bedding height: (j) to comfort preference; (k) to corner guards; (l) to replacement of another piece in a sleep set; (m) to sheet fit; (n) to fabric stains, soiling, fluid penetration, tears or burns; (o) to sagging that measure less than 1 1/2" in depth; (p) to Foundation(s) sold by resellers who are not authorized retailers; (q) any problems that result from the Foundation not being properly installed as instructed in the installation manual provided by Reverie or published on www.reverie.com

Reverie reserves the right to invalidate this Limited Warranty if the frame used by Purchaser is determined, in Reverie’s discretion, to be inadequate, in an unsanitary condition, or shows any signs of abuse, mishandling, improper installation, or misuse.

Repairs to or of the Foundation or its components under the terms of this Limited Warranty will apply to the Warranty Period and will not serve to extend theWarranty Period. No new warranty will be provided with any replacement foundation, in case one is offered at Reverie’s sole discretion. Purchaser may be required to surrender the original Foundation to us at Reverie’s sole discretion.

The decision to repair or to replace defective parts under this Limited Warranty shall be made exclusively by Reverie in its sole discretion.

REPAIR OR REPLACEMENT SHALL BE THE SOLE REMEDY OF THE PURCHASER, IF ANY. THERE SHALL BE NO LIABILITY ON THE PART OF REVERIE AND ITS SUBSIDIARIES, DIVISIONS OR AFFILIATES FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR FOR ANY OTHER DAMAGE, CLAIM, OR LOSS NOT EXPRESSLY COVERED BY THE TERMS OF THIS LIMITED WARRANTY.

This Limited Warranty does not include reimbursement for inconvenience, removal, installation, setup time, loss of use, shipping, or any other costs or expenses.

UNLESS OTHERWISE EXPRESSLY STATED IN THIS DOCUMENT, REVERIE AND THEIR RESPECTIVE PARENTS, SUBSIDIARIES, DIVISIONS AND AFFILIATES EXPRESSLY DISCLAIM ANY OTHER WARRANTY WHATSOEVER, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND FREEDOM FROM DEFECTS AND WORKMANSHIP.

Some states may not allow the exclusion or limitation of incidental or consequential damages in some circumstances, so the above limitation or exclusion may not apply to every Purchaser. This Limited Warranty gives the Purchaser specific legal rights, and the Purchaser may also have other rights, which may vary from state to state. This Limited Warranty is valid in all states of the United States except Alaska, Hawaii, and Puerto Rico.

If you experience any trouble with your Foundation during the warranty period, please consult the troubleshooting guide provided with your Foundation and online (if applicable), or the troubleshooting video provided online (if applicable). If problems persist after following these instructions, please email at customerservice@reverie.com with the subject line as your Foundation product code and serial number and attach the purchase receipt. Not providing the aforementioned information can cause delays in resolving any issue.
